1. Introduction

Welcome to VS Price, a mobile application that provides users with product price information from various supermarkets in Hong Kong. This application utilizes data from the HK Consumer Council's open API. These Terms and Conditions ("Terms") govern your access and use of the VS Price application ("App"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the App.

2. Use of the App

You may use the App only for lawful purposes and in accordance with these Terms. You agree not to use the App:

• In any way that violates any applicable law or regulation.
• For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
• To send, knowingly receive, upload, download, use, or re-use any material which does not comply with these Terms.
• To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter", "spam", or any other similar solicitation.
• To impersonate or attempt to impersonate the HK Consumer Council, VS Price, or any other person or entity.
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the App, or which, as determined by VS Price, may harm VS Price or users of the App or expose them to liability.

3. User Content

The App may allow you to submit, upload, post, or otherwise make available content, including but not limited to text, images, and videos ("User Content"). You are solely responsible for your User Content and the consequences of posting or publishing it.

You represent and warrant that:

• You own or have the necessary licenses, rights, consents, and permissions to use and authorize VS Price to use all User Content that you submit, upload, post, or otherwise make available.
• Your User Content does not and will not violate these Terms or any applicable law or regulation.

4. Disclaimer of Warranties

The App is provided "as is" and "as available" and without warranties of any kind, express or implied. VS Price disclaims all warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, non-infringement, and title. VS Price does not warrant that the App will be uninterrupted or error-free, that defects will be corrected, or that the App is free of viruses or other harmful components.

5. Limitation of Liability

VS Price will not be liable for any damages of any kind arising from the use of the App, including, but not limited to, direct, indirect, incidental, punitive, and consequential damages.

6. Indemnification

You agree to indemnify and hold harmless VS Price and its officers, directors, employees, agents, licensors, and suppliers from and against all claims, demands, losses, liabilities, costs, and expenses, including attorney's fees, arising out of or in connection with your use of the App or your violation of these Terms.

7. Termination

VS Price may terminate your access to the App for any reason, at any time, without notice.

8. Governing Law

These Terms will be governed by and construed in accordance with the laws of Hong Kong.

9. Dispute Resolution

Any dispute arising out of or relating to these Terms will be resolved by arbitration in accordance with the rules of the Hong Kong International Arbitration Centre. The arbitration will be conducted in English and will be held in Hong Kong.

10. Entire Agreement

These Terms constitute the entire agreement between you and VS Price regarding your use of the App.

11. Changes to the Terms

VS Price may revise these Terms at any time by posting the revised Terms on the App. You are responsible for checking these Terms regularly. Your continued use of the App after the revised Terms are posted will be deemed your acceptance of the revised Terms.
